A public oral auction will be conducted at the Idaho Department of Lands office, 1806 Main Avenue, St. Maries, ID 83861, at 9:00 a.m. local time, on Tuesday, June 4, 2019 for an estimated 7,120 MBF of timber marked or otherwise designated for cutting. In addition, there is an unestimated volume of forest products that may be removed at the option of the purchaser. Prior to bidding, eligible bidders shall present a certified check or bank draft payable to Treasurer, State of Idaho, or a bid bond acceptable to the State, in the amount of $150,062.25 which is 10% of the appraised net sale value of $1,500,622.50. The successful bidder’s deposit will be forfeited to the State should the bidder fail to complete the contract. RESOLUTION OF THE PLUMMER CITY COUNCIL PROVIDING STATUTORY NOTICE TO OWNERS, OR HEIRS OF OWNERS, OF LOTS, SITES, OR PORTIONS OF THE CEMETERY WHICH WERE PURCHASED BUT REMAIN UNUSED FOR BURIAL PURPOSES FOR A PERIOD OF FIFTY (50) YEARS OR MORE, PURSUANT TO IDAHO CODE TITLE 27, CHAPTER 3, AND DIRECTING CITY STAFF TO MAKE SAID LOTS, SITES, OR PORTIONS OF THE CEMETERY AVAILABLE FOR PURCHASE FOR BURIAL PURPOSES IN THE EVENT THEY ARE NOT RECLAIMED DURING THE STATUTORILY PROVIDED SIXTY (60) DAY PERIOD FOLLOWING SERVICE, MAILING OR PUBLICATION OF THIS RESOLUTION.
WHEREAS, the City of Plummer owns and operates the Evergreen Cemetery, located at 833 Fairfield Road, Plummer, Idaho 83851;
WHEREAS, pursuant to Idaho Code § 27-301(1), the City has identified those lots, sites or portions of the cemetery which were purchased by private parties but which have remained “unused for burial purposes for more than fifty (50) years”;
WHEREAS, after identifying said lots, sites or portions of the cemetery, City staff attempted to locate and contact the owners of all of said spaces, or, if the owner is deceased, the reasonably ascertainable heirs of the owner, which heirs were ascertained, where possible, through an inquiry into the next succeeding owner(s) of the decedent’s real property and through a basic online search for information about the heirs of the deceased owner;
WHEREAS, where the owner or an heir of a deceased owner was identified, and expressed an interest in any such lot, the city prepared and executed such documents as were necessary to convey the right to use of such lot for burial purposes to said person; and
WHEREAS, the City has not yet been able to locate either an owner or an heir of the owner with respect to 93 of the identified lots, and, therefore, wishes to adopt this Resolution in order to provide statutory notice to said persons, in accordance with Idaho Code § 27-301(3) and (4), and to mail a copy of this resolution to any owner for whom the city is in possession of a “last known address.”
NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Mayor and City Council of the City of Plummer, Idaho, as follows:
1. That this Resolution shall constitute the statutorily required notice, set forth in Idaho Code § 27-301(2), to the owners, or to the heirs of any owner, identified in the attached list of cemetery spaces or lots which appear to have been abandoned in that they have been purchased but remain “unused for burial purposes form ore than fifty years,” said list being marked as Exhibit “A,” and incorporated herein by reference;
2. That all owners and each owner listed in said Exhibit “A,” or all heirs or any individual heir of any deceased owner listed therein, shall “express his or her interest in maintaining the cemetery lot, site or portion of the cemetery [identified in Exhibit “A”] by filing with the city clerk a written statement of his or her continuing claim or interest in the lot, site or portion of the cemetery,” and must do so within SIXTY (60) DAYS of the date of personal service, mailing, and/or publication of this Resolution.
3. For all owners listed in Exhibit “A” which are known to be living, if any, the City Clerk shall cause a copy of this Resolution to be served personally upon said owner or by leaving a copy thereof at his or her dwelling house or usual place of abode with some person over the age of eighteen (18) years then residing therein. If it is determined that the owner is deceased, the City Clerk shall cause a copy of this Resolution to be mailed to all known or reasonably ascertainable heirs of the owner, following a search for heirs which shall include an inquiry into the next succeeding owner(s) of the deceased owner’s real property and a basic online search for information about the heirs of the deceased owner. If neither the owners listed in Exhibit “A” nor any living heir can be located, the City Clerk shall publish this Resolution for three (3) successive weeks in the Idaho Press Tribune and shall mail a copy of this Resolution within fourteen (14) days after said publication to the owner’s last known address, if available.
4. Should the owner or the heirs of the owner of any lot, site or portion of the cemetery listed in Exhibit “A” fail to provide written notice to the City Clerk of an interest in maintaining his or her rights in the cemetery lot, site or portion of the cemetery in question, within the prescribed sixty (60) day timeframe, said owner’s rights, or the rights of his or her heirs and/or assigns, shall be considered abandoned and terminated, with all rights in and to said lot, site or portion of the cemetery immediately vesting in the City of Caldwell as set forth in Idaho Code § 27-301(6). All such lots, sites, or portions of the cemetery shall be made available to the public for purchase for burial purposes.
